On April 10, 2025, the President of the Republic of Poland, Andrzej Duda, signed the Act on the Conditions for Granting Permission to Assign Work to Foreigners and the Act on the Labor Marke

The new laws introduce a number of important changes aimed at simplifying the procedures for employing foreigners and increasing security in the labor market. The most significant of these include:

  • Tougher penalties for illegal employment:
    Employers who illegally employ foreigners will be fined between PLN 3,000 and PLN 50,000 for each case of such employment.
  • Full digitalization of procedures:
    The process of issuing work permits will be fully digitized, including the submission of applications and the receipt of decisions. The aim is to shorten processing times and simplify administrative procedures.
  • Abolition of the labor market test:
    Instead of the current labor market test, the district governor (starosta) will be able to define a list of professions and types of work for which work permits will not be granted to foreigners in a given area, especially in the event of a deterioration in the local labor market situation.
  • Employers' information obligations:
    Employers will be required to submit information via the praca.gov.pl system in the following cases: when a foreigner starts work (within 7 days of starting work), when a foreigner does not start work (within 14 days from the date indicated in the statement register), or when a foreigner terminates employment earlier than planned.
