Who shall be considered a family member?Print

A foreigner’s family member is considered to be:

  1. a spouse (the marriage must be recognized under Polish law);
  2. a minor child (including an adoptive child) of that foreigner and his spouse
  3. the foreigner’s dependent minor child (including an adoptive child) with respect to whom the foreigner exercises factual parental authority
  4. a dependent minor child of the foreigner’s spouse (including an adoptive child) with respect to whom the foreigner exercises factual parental authority

A foreigner who resides in Poland:

  1. on the basis of a residence permit;
  2. on the basis of a long-term EU resident permit
  3. on the basis of refugee status
  4. with supplementary protection
  5. on the basis of a residence permit for a specified period, including directly prior to submission of an application for a family member – on the basis of a permit issued for a residence period not shorter than one year;
  6. on the basis of a residence permit for a specified period granted to a foreigner who is a scientist working in Poland

shall have the right to be united with his family members residing outside Poland.
