A temporary residence permit is granted to foreigners if the aim of their stay in Poland is to start or to continue a full-time 1st degree (undergraduate), 2nd degree (graduate), integrated Master's degree or 3rd degree (doctoral) studies programme. The residence permit is granted also in the case that such studies are a continuation or are complementary to a course of study that the foreigner is pursuing in another EU Member State. In order to obtain a residence permit issued for the purpose of udnertaking higher education, the foreigner should meet all of the following conditions:

  1. present a statement from the academic institution confirming enrolment in a course of study or the continuation of studies compliant with the required template (template available here ->);
  2. present proof of payment of the tuition fee if they are starting or continuing a paid course of study;
  3. have health insurance (documents confirming the possession of health insurance ->);
  4. have sufficient financial means to cover living costs in Poland (what financial means are sufficient to cover living costs ->?);
  5. have sufficient financial means to cover the costs of the return trip to the country of origin (what financial means are required to cover the costs of the return trip ->?);
  6. has a guaranteed place of residence (what is a guaranteed place of residence? ->)

The first temporary residence permit for the purpose of higher education is granted for a period of 15 months.  If the documents presented by the student applying for the permit justify their stay in Poland lasting less than 1 year, the first permit will be issued for the duration of the academic year or of the course of study, extended by 3 months (for example, if there are 5 months remaining until the end of the academic year, the temporary residence permit will be issued for 8 months).

The second and each subsequent temporary residence permit granted to the foreigner will be issued for a period of up to 3 years, on general terms.

A foreigner will not receive a temporary residence permit issued for the purpose of undertaking higher education if they perform work or conduct business activity in Poland, unless they apply for a subsequent residence permit for the purpose of undertaking higher education. If this is not a subsequent residence permit, a foreigner performing work in Poland should apply for a temporary residence and work permit, and a foreigner conducting business activity in Poland should apply for a temporary residence permit issued for the purpose of conducting business activity.

If a foreigner has received a temporary residence permit but has been removed from the list of students, the academic institution shall notify the Voivode who issued the temporary residence permit of this fact in writing. This may constitute a basis for the withdrawal of the residence card, as the aim of the stay in Poland constituting grounds for granting the temporary residence permit to the foreign student ceases to exist.
