Based on analysis of Polish legislation, one notices that the situation of separated children in - guarantees and provisions provided to separated children - is determined by the child’s legal situation.
The Act of 13 of June 2003 on granting protection to aliens within the territory of the Republic of Poland defines “an unaccompanied minor as a minor foreigner, who arrives or who stays on the territory of the Republic of Poland unattended by any adults, responsible for him/her pursuant to the law or customary norm”[1]. Since the term separated child does not exist in the Polish legislation, in this section both terms separated child and unaccompanied minors are used interchangeably. .
